Terms of Service

By accessing or using the OCL Nexus platform (“the Service”), provided by OCL Hosting (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

1. The Service: Orchestrated Compute Layer

OCL Nexus provides an infrastructure-as-a-service (IaaS) platform consisting of isolated Kubernetes (K3s) namespaces, compute blueprints (sandboxes), persistent storage, and networking tools designed for agentic development.

OCL Nexus is a passive infrastructure provider. We provide the “fabric” (compute and storage); you provide the “logic” (code, scripts, and configurations).

2. User Responsibility for Workloads

You maintain absolute and exclusive control over the environments you deploy.

  • Code and Content: You are solely responsible for any code, scripts, data, or content uploaded to, stored within, or executed by your workloads.
  • Execution Consequences: You assume all liability for the actions taken by your autonomous agents. OCL Nexus does not monitor, audit, or assume responsibility for the logic executed within your instances or the consequences of those actions on third-party systems (e.g., APIs, web services, or messaging platforms).
  • Publication: If your workload serves public traffic via an OCL Nexus subdomain, you are the sole publisher of that content. You must ensure that any output generated or hosted by your instance complies with all applicable laws.

3. Prohibited Use and Misconduct

The Service must not be used for illegal, harmful, or abusive activities. Prohibited conduct includes, but is not limited to:

  • Infrastructure Attacks: Using the Service to launch DDoS attacks, port scanning, or unauthorized vulnerability testing.
  • Malicious Code: Deploying malware, viruses, or self-replicating scripts.
  • Spam and Harassment: Using agents to generate unsolicited bulk communications or automated harassment.
  • Resource Abuse: Attempting to circumvent resource limits (CPU/RAM/Disk) or exploit the underlying Kubernetes orchestration layer.
  • Illegal Activity: Any use that violates European Union laws or the laws of your local jurisdiction.

4. Right to Revoke Service

We reserve the right to suspend or terminate any workload or user account immediately and without notice if, in our sole discretion, we detect activity that violates these terms or threatens the stability and security of our infrastructure. In cases of misconduct, OCL Nexus is not obligated to provide a refund of remaining prepaid credits.

5. Billing and Prepaid Credits

  • Metered Model: OCL Nexus operates on a prepaid credit system. Usage is billed hourly based on the active state of your workloads.
  • Auto-Suspension: When your account balance reaches zero, active workloads will be automatically suspended (scaled to zero replicas). OCL Nexus is not liable for data loss or service interruption caused by insufficient funds.
  • Credit Expiration: Prepaid credits are non-refundable unless required by law.

6. Bring Your Own Key (BYOK) Policy

OCL Nexus does not provide LLM model access. You must provide your own third-party API keys (OpenAI, Anthropic, etc.). You are responsible for the costs incurred on those third-party platforms and for securing your keys. OCL Nexus encrypts these keys at rest but assumes no liability for their use.

7. Limitation of Liability and Indemnity

  • “As-Is” Basis: The Service is provided without warranties of any kind. We are not liable for any service interruptions, hardware failures, or loss of data.
  • Indemnification: You agree to indemnify and hold harmless OCL Nexus and its operators from any claims, damages, or legal fees arising from your use of the Service, the code you execute, or the actions of your agents.

8. Data Sovereignty

OCL Nexus is an EU-based provider. All compute resources and data storage are located in ISO-certified datacenters within Germany and Finland.
